Rendezvous Retreats Terms and Conditions Associated with a Reservation
A reservation forms a legal contract between Rendezvous Retreats and the Guest for provision of and payment for accommodation as detailed. Reservations are made and accepted on the following terms:
Definitions:
Guest – The representative signing the Contract and making the reservation.
House – Property located at 79 4th Avenue S.W., Forest Lake, Minnesota 55025.
Parties – Guest and Rendezvous Retreats.
Premises – Includes the House as well as the surrounding property owned by Rendezvous Retreats and its owners.
Reservation – The booking of the House and request to reserve the House for personal use.
Accommodation Offered:
Rendezvous Retreats undertakes to supply the premises reserved on a specific basis for the price given.  Alterations will not be made without the approval of the Guest and such alterations must be in writing and agreed to by both Parties. Rendezvous Retreats accepts no responsibility for guests reserving un-suitable accommodations. Rendezvous Retreats reserves the right to refuse or cancel a reservation it considers inappropriate.
Check-In and Check-Out  Times:
Check-in is by appointment.
When is check in?
As early as 7:00 a.m. for daily rental and 5:00 p.m. for evening rental. For overnight stay you can check in as early as 9:00 a.m. the day of your overnight.
When is check out?
As late as 4:00 p.m. for daily rental and 9:00 p.m. for evening rental. For overnight stay you can check out as late as 9:00 p.m. the day following your overnight stay.
Reserving a Date and Payment:
Guests can reserve a date by supplying Rendezvous Retreats with a credit card hold.  Payment for this reservation will be charged to this credit card 24 hours prior to the reserved date.  If another method of payment is preferred, please supply payment 10 days before the reserved date and the Guest’s credit card will not be charged for the reservation.  If a check is not honored based upon insufficient funds, a stop payment or any other reason, Rendezvous Retreats reserves the right to impose a $30.00 charge in addition to the underlying payment due and owing for the reservation.
Cancellation Charges:
When a cancellation is made 1 month or more before the day of arrival a $25.00 administrative fee will be charged to the credit card on hold.  When a cancellation is made later than 1 month before the day of arrival, the Guest will be required to pay a cancellation charge of ½ the rental rate at the House rate quoted for the reservation. When a cancellation is made later than one week before the day of arrival or by way of a ‘no-show’, the Guest will be required to pay in full the rental rate at the House rate quoted for the reservation.  The credit card on hold for that reservation will be debited with the cancellation charge unless other payment methods are offered and approved. Where payment has been made in advance, payment will not be refunded upon cancellation.  When a reservation is for a two night minimum, cancellation of one of those nights will not be allowed and cancellations before or after arrival will be subject to payment in full.
Consumption of Alcohol or Other Drugs:
By signing this Contract, the Guest agrees that consumption of alcohol or other drugs by them or their party guests’ is entirely the responsibility of the Guest and agree to hold Rendezvous Retreats harmless for any and all problems that may arise from consumption of alcohol or other drugs on the premises.  Unauthorized purchase, manufacture, distribution, possession, sale, storage or use of an illegal drug or controlled substance while on the premises is prohibited. If the Guest or any person(s) attending the event are caught engaging in any illegal activity, you WILL be removed from the premises and turned over to the proper authorities.
Smoking Prohibited:
Rendezvous Retreats offers a non-smoking accommodation for the convenience and safety of all guests. However, there is a designated area for smoking outside. Guests and/or person(s) attending the event who smoke in the House will be asked to leave, will be charged a $250 fee for dry-cleaning of soft furnishings from the House and may be charged for loss of income and cost of cleaning caused by the need to extensively ventilate the house before the next letting. Rendezvous Retreats reserves the right to add these costs to the Guest’s account after departure. In the case of credit or debit card reservation, the card of the Guest or the party responsible for the reservation will be debited with the costs unless other payment methods are offered and approved by Rendezvous Retreats.
Damage:
Rendezvous Retreats holds the Guest responsible for any damage to floors, carpeting, and other furnishings, including but not limited to indoor and outdoor items on the premises as a result of abusive treatment by any person(s) attending the event. Rendezvous Retreats is not responsible for theft, damage to Guest property, or personal injury during the time of this Contract. The Guest is responsible for damage caused by party guests’ misuse of the House.  If damage does occur, the Guest’s credit card will be charged for such damage.
Bed Usage: 
Bed usage is intended for Overnight Guests only.  Any disruption to the beds during day or evening rental will be charged $25.00 per bed.  Please advise Guests and their children to refrain from using, sitting on or playing on beds to avoid additional charges.
Rules to Ensure Safety and Quality of Stay for all Guests:
By reserving the premises, Guest agrees to abide by the rules imposed by Rendezvous Retreats, which are created to ensure the safety and quality of stay for all Guests. Refusal to comply with these rules will lead to a Guest being asked to leave without refund of payment. The Guest is accountable for the behavior of children. Please bring quiet games or toys to keep them busy. Please prohibit them from running in the House and engaging in unruly behavior. Rendezvous Retreats reserves the right to ask that any disorderly person(s) leave the property without explanation. The Guest is responsible for the conduct of person(s) attending the event and financially responsible for the event. The Guest is also libel for any theft, damage to Guests’ property or the House, as well as any and all personal injury during the time of this Contract.
Waiver and Release of Liability:
In consideration of the above, the Guest agrees to waive, release and covenant not to sue Rendezvous Retreats and/or their property owners, owners, employees, officers, directors, agents, representatives, affiliate owner, and attorneys (collectively the “Released Parties”), of and from, any and all claims, demands, damages, causes of action, and liabilities of any kind and nature, whether known or unknown, which the Guest ever had, now has or will have, arising from, on account of, growing out of, or in any way related to, the reservation, the premises, the conduct of the Released Parties, the Guest’s own conduct or the conduct of person(s) attending the event, whether or not due to his/her own negligence, acts, or omissions, or the negligence, acts or omissions of his/her child or other third parties, or the Released Parties, for any and all known and unknown personal injuries, death, disabilities, damages, or intangible damages occurring at the time hereafter. The Guest acknowledges that it is his/her intention to fully and completely waive and release the Released Parties from all such known and unknown matters and claims.
The Guest hereby agrees to indemnify, defend and hold harmless the Released Parties against any and all claims, demands, actions, causes of action, liability, losses, damages, costs, expenses and reasonable attorneys’ fees, which Released Parties may incur in any way related to the Guest’s conduct, the use of the House, or the reservation.
The Guest declares that he/she has fully read and understood this final and complete Waiver and Release of Liability. The Guest declares that he/she has not been influenced to any extent whatever in making this release by any representations or statements made by the Released Parties. The Guest hereby acknowledges and agrees that no representation or warranty of any kind or nature whatsoever has been given to him/her regarding the condition of the House. This Waiver/Release contains the entire agreement between the Guest and the Released Parties, and the terms of this Waiver/Release are contractual. This Waiver/Release may not be modified in any way. If any part of this Waiver/Release is determined to be invalid by law, all other parts of this Waiver/Release shall remain valid and enforceable. This Waiver/Release shall be governed by the laws of the State of Minnesota.
